Your privacy is very important to us. Accordingly, we have developed this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal data we receive when visiting one of our websites or mobile applications. All of our mobile and web applications will be collectively referred to as the “App” and all of the underlying servers and software structures that support such applications, as well as the www.enhatch.com website, will be referred to herein as the “System”.

This Privacy Policy applies to the information that you, the user, provide to us through interaction with the App and the System. We collect and use personal information solely to fulfill those purposes specified by us and other compatible purposes. All other forms of data collection and data use conducted by our organization are not implemented unless we obtain the consent of the individual concerned or as required by law. We will only retain personal information as long as necessary for the fulfillment of those purposes previously mentioned. We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned. Personal data should be relevant to the purposes for which it is to be used, and should be accurate, complete, and up-to-date to the extent necessary for those purposes. We will protect personal information by implementing reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. We will make readily available to customers information about our policies and practices regarding the management of personal information. We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is maintained and protected.

This Privacy Policy should further be read together with the applicable contractual documentation provided in our service agreements. These documents constitute the entire and exclusive agreement, herein collectively referred to as the “Agreement,” between Enhatch and you, the user, regarding the subject matter thereof. These supersede and replace any prior agreements between Enhatch and you, the user, regarding the System, App, and the use thereof (including pricing).

Information Collection
During the course of using the System and App, you may provide us with personal data. This refers to information about you, the user, that can be used to contact or identify you, as well as information regarding your use of the App and the System that can be traced to you (“Personal Data”). Personal Data that we collect may include, but is not limited to, your name, phone number, credit card or other billing information, email address, and home and business postal addresses. Personal Data may also include information you, the user, supply to us concerning your preferences and interests expressed in the course of using the App and System.

In addition, our surgical case portal offers a calendar availability feature that allows users to link their calendar with our site so that other users can view their availability. This feature utilizes the calendar event scopes for both Google and Microsoft to access and display users' calendar information. By explicitly consenting to link their calendar, users acknowledge and agree to allow our site to access their calendar data for the purpose of displaying their availability to other users.

The purpose of collecting this data is to enhance the user experience and enable users to easily schedule meetings and appointments with other users.

Architecturally, the tokens used to access calendar and availability data are stored and managed only in the backend and are stored with encryption to ensure their security. We take appropriate measures to safeguard your calendar data and ensure that it is used in accordance with this privacy policy.

We may collect and use the following calendar data :
- Event titles, descriptions, locations, and start/end times
- Attendee lists for events
- Events created through the application
- Recurrence patterns for events

We do not collect any sensitive personal information from your calendar, such as the contents of your emails or the details of your private events. However, please note that the information that you choose to share through this feature will be visible to other users on our site.We do not share your calendar data with third parties, except as necessary to provide this feature and as required by law. We may use aggregated and anonymized data for research and analytics purposes.

When you use the App and/or visit the System, our servers automatically record information that your App and/or browser sends during an activity. This information may include, but is not limited to, your computer’s Internet Protocol address, browser type, the web page you were visiting before you came to the System, and information you search for in the System. WiFi and IP addresses received from your App or browser may be used to determine approximate location. Precise GPS location of your device is collected only during interaction with the App or System and with your permission.

How We Use Personal Information
Personal Data is or may be used for the following purposes:
(i) to provide and improve the System, App, and Services (as defined in the Terms of Service) and other services, features and content offered by Enhatch,
ii) to administer your use of the System,
(iii) to enable you to enjoy and easily navigate the System,
(iv) to better understand your needs and interests,
(v) to fulfill requests you may make,
(vi) to personalize your experience,
(vii) to provide or offer software updates and product announcements, and
(viii) to provide you with further information and offers from us that we believe you may find useful or interesting, including newsletters, other marketing or promotional materials, and information on services and products offered by us or third parties.

If you decide at any time that you no longer wish to receive further information and offers from us through channels of communication in which the information and offers are sent, please follow the “unsubscribe” instructions provided in any of the materials sent to you.
We use technical practices to obtain information, such as automatic record-taking performed by our servers or the browser through the use of cookies,  in order to fulfill the purposes previously mentioned and monitor and analyze the use of the App, the System, and our services. Furthermore, the collection of data in this manner is meant to support the technical administration of the App and System, increase the functionality and user-friendliness of the App and System, better tailor the App and System to your needs, generate and derive useful data and information concerning the interests and use behavior of our users, and verify that visitors to the App and System meet the criteria required to process their requests.
Enhatch does not share, sell, rent, or trade personal data with third parties for their promotional purposes. Enhatch may share information collected with other companies that work on Enhatch’s behalf.

Information Sharing and Disclosure

Enhatch Users
We will display your Personal Data in your account page and elsewhere on the App and System according to the preferences set in your account.

Service Providers, Business Partners and Others
We may employ third party companies and individuals to help facilitate in the delivery of our services, provide a service on our behalf, perform System-related services (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, and improvement of the System’s features), or assist us in analyzing the use of our services or products. These third parties may have access to your Personal Data, but only for purposes of performing these tasks on our behalf.

Compliance with Laws and Law Enforcement Requests; Protection of Enhatch’s Rights
We may disclose to parties outside Enhatch about files stored in your Enhatch Account and information about you, the user, that we collect when we have a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation, or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of Enhatch or its users; or (d) to protect Enhatch’s property rights.

Business Transfers
Enhatch may sell, transfer, or otherwise share some or all of its assets, which may include your Personal Data, in connection with a merger, acquisition, reorganization, or sale of assets of Enhatch. These actions are also applicable in the event of bankruptcy.

Customer Data
Customers of Enhatch may electronically submit data or information to the company’s services (“Customer Data”). However, Enhatch will not review, share, distribute, or reference any such Customer Data. Enhatch may access Customer Data only for the purposes of providing its services, preventing technical problems, addressing a Customer’s request in connection with customer support matters, or as may be required by law.

Marketing
If you register to use our App and System, we will from time to time, send you information about upgrades when permissible. Users who receive these marketing materials can opt out at any time. If you don’t want to receive a particular type of marketing material from us, click the ‘unsubscribe’ link in the corresponding emails, or update your preferences in the notification section of your personal account.

We sometimes contact people who are not existing users of our App and System. For recipients in the4 EU, we or a third party will obtain consent before reaching out. If you receive an email and no longer wish to be contacted by Enhatch, you can unsubscribe and remove yourself from our contact list via the message itself.

Cookies and other Tracking Technologies
Technologies such as: cookies, beacons, tags and scripts are also used by Enhatch, our advertising partners, and service providers. These technologies are used in analyzing trends, managing the System, tracking users' movements around the System, and gathering demographic information about our user base as a whole. For the purpose of this policy we will refer to all of these technologies as “cookies”. We may receive reports based on the use of these technologies by our partners on an individual and/or aggregated basis.
We use cookies for remembering users’ settings on our website (e.g. language preference) for authentication. Users can control the use of cookies at the individual browser level. If you, the user, reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.
As is true of most web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We do link some of this automatically-collected data to personal information. We do this to improve services we offer you, the user, including marketing, analytics, or site functionalities.
We also use local storage, including HTML5 local storage and browser cache. Local storage allows us to store information locally on your browser or device to improve your experience, such as to remember your settings for whether you prefer to view your folders in a list or as thumbnails.
We currently partner with a third party ad network to either display advertising on our website or to manage our advertising on other sites. Our ad network partner uses cookies to collect non-personal information about your activities on this site and other websites to provide you targeted advertising based upon your interests.
We use mobile analytics software to allow us to better understand the functionality of our Apps. This software may record information such as how often you use the application, the events that occur within the application during use, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personal information you submit within the mobile application

.Changing and Deleting Your Information
You, the user, may review, update, correct or delete the Personal Data provided in your registration or account profile by accessing the “account settings”.

Security
Enhatch is very concerned with safeguarding your Personal Data. We employ reasonable measures designed to protect this information from unauthorized access. We do not sell, trade, or otherwise transfer to outside parties your personal data except as follows:To trusted third parties who assist us in operating our website and conducting our business and who have contractually agreed with us to keep this information confidential and to use it only for the purposes of providing services to us;When we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others rights, property, or safety.In addition, if we ever decide to sell our business we may provide the information to a potential acquirer but only to the extent customary in these circumstances and subject to the potential acquirer’s agreement to maintain the information in confidence and use it only for the purpose of evaluating the potential acquisition.

Children’s Online Privacy Protection Act Compliance
We do not intentionally collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

Transfers from European Union and other jurisdictions
If we transfer personal data from the European Union to the United States or other jurisdictions, we will comply with applicable laws governing the transfer, such as signing the EU’s Standard Contractual Clauses with the data exporter. We will comply with other laws applicable to personal data transferred by us to the United States from other jurisdictions. We do not transfer personal data covered by this Privacy Policy out of the United States without the consent of the data subjects.

Compliance with HIPAA and FDA Regulations
Our practices adhere to the Health Insurance Portability and Accountability Act (HIPAA) standards to protect sensitive health information. This includes protecting PHI, ensuring user rights under HIPAA, employing safeguards, and adhering to breach notification protocols.
As a provider of services and software that have received 510(k) clearance from the U.S. Food and Drug Administration (FDA), we adhere to FDA regulations. This includes maintaining software reliability, data integrity and security, conducting post-market surveillance, and adhering to adverse event reporting requirements.

Changes to our Privacy Policy
We may change our Privacy Policy at any time, but no change is effective as to personal data that we collect prior to the change unless the change provides additional protections for your personal data. We have updated our privacy policy on 1-06-2024 to include a new section regarding our practice with HIPAA and FDA Regulations. By continuing to use our services, you agree to the updated privacy policy. We encourage you to review the policy periodically for any updates or changes
